Terms and Conditions
Before confirming your order with The Master Cakesmith please read the below Terms and Conditions.
This document tells you the terms and conditions in which we sell and supply goods to you. In these terms and conditions, the Company is defined as the legal entity The Master Cakesmith and the Customer means you the person purchasing the goods as named on the invoice.
Payment of your booking deposit confirms you agree with our Terms and Conditions.
1. Bookings - We require a £150.00 non-refundable deposit for wedding cake orders and full payment for and all other orders. Your date is not secured, and your order not confirmed, until we receive your payment/deposits. If not received within 7 days the date will be freed up for other bookings. Deposits are for goods as detailed on the Customers invoice and non-refundable or transferable.
2. Minimum Spend - For all 2024 bookings we have a minimum spend of £500.00. For 2025 bookings we have a minimum spend of £550.00 excluding delivery, fresh flowers and additional costs i.e. silk ribbons, stencils etc.
3. Remaining Balance - The remaining balance is due by the date shown on the invoice, at which point all designs must be confirmed. Changes to the previously agreed design will incur an administration fee of £75.00 to cover extra admin & appointments if required. If the balance is not paid the Company reserves the right to cancel the order.
4. Cancellations - CANCELLATION BY YOU – Once a booking is confirmed you are responsible for the total cost of the cake as shown on the invoice/quote. We therefore strongly recommend that you take out wedding insurance. If we are informed of a cancellation, in addition to the nonrefundable deposit a set fee of £20.00 for admin and samples will be invoice. For cancellations within 3 months 50% of your final payment is payable. If a final design has not been confirmed 50% of the min spend will be payable. For cancellation within 6 weeks of your wedding date you will be responsible for the full cost of your booking or 100% of the min spend if a design is not confirmed. In all circumstances you will forfeit any refund if your wedding date is or is not resold. In all circumstance’s cancellations must be made in writing and you must receive confirmation from the Company that the booking is cancelled. If you have not received a confirmation the booking has not been cancelled and all monies owed will be payable. Booking deposits and transfer fees are non-refundable or exchangeable such as, but not limited to, birthday cakes, wedding favours, sweet treats etc. CANCELLATION BY US – The Company reserve the right to cancel your booking if, for unforeseen circumstances, we are unable to fulfil your order. Under such unlikely circumstances you will be refunded your deposit and any monies paid in full.
5. Illness & Covid - If your celebration in unable to go ahead due to illness or restrictions surrounding COVID and you wish to postpone your order, both parties must agree to the new proposed date. In the event we are not available our cancellation policy (above) remains. If the Company cancels your booking due to illness or COVID restrictions all monies paid will be refunded in line with our cancellation policy
6. Postponed Weddings - The Company will reschedule your date if they are available for a non-refundable transfer fee of £100.00. The fee will then be offset against your wedding cake should your wedding go ahead on the new date. If your wedding does not go ahead the transfer fee is non-refundable or exchangeable. Postponements are available up until 6 weeks before your wedding date. After this date it is non-transferable and your final balance for the original date is payable. The Company reserve the right to amend prices in line with current/market prices for the new date. If the Company are unable to reschedule all deposits and booking fees are non-refundable or transferable.
7. Quotations - All quotations will be sent after your design appointment via e-mail and are valid for 7 days from date of issue. The Company reserve the right to revise prices after this period.
8. Design - Due to the handmade nature sometimes it is not possible to follow the design brief. The company reserve the right to amend the design if they feel the overall look would benefit i.e. flower placement, ribbon placement. In the case when a stencil does not sit flush, the Company will not overpaint to prevent bleeding behind the stencil.
9. Prices - The Company reserve the right to increase prices in line with the market price of ingredients and goods at any time.
10. Delivery - The Company will not accept any liability when it is not able to deliver due to adverse weather or road condition, traffic chaos or other highway hazards. The Company shall not be responsible for any default in its obligations where delivery is prevented or delayed because of illness, bereavement, war, civil strife, drought, flooding, electricity failure, acts of nature or any other event beyond the reasonable control of the Company.
11. Damages - Once your order has been delivered the Customer is responsible for it and the Company will not accept responsibility for any damage.
12. Hot Weather - We cannot guarantee your cake will not be damaged or be affected by hot weather. The Company will advise in the week of the wedding if the design should be changed, or any extra precautions are required in hot weather. Under no circumstances should iced cakes be refrigerated.
13. Flowers - The Customer is responsible for booking all fresh flowers with their florist. The Company cannot be responsible for the quality or quantity that the Customers florist provides for us. Flowers are to be none toxic loose stems/foliage that we can then fix to the cake in a hygienic and food safe manor. The placement of the flowers will be subject to the amount and type provided by your florist.
14. Allergies - The Company cannot guarantee any of its products do not contain any substance that may cause some form of allergic reaction. The Customer is responsible for advising their guests of this and the Company will not accept any liability for any loss, damage or injury from exposure to anything which might cause an allergic reaction such as, but without limitation, nuts, nut products, alcohol, dairy, wheat, sulphates, fish or colourings. A full allergen list will be provided, we strongly recommend this is forwarded to your venue, or printed off, and displayed alongside the cut cake.
15. Nontoxic Food Safe Decoration - The Customer should note that some items used to decorate are nontoxic food safe items i.e. glitter, copper leaf, shimmers. These items all have a product information sheet for traceability, are food safe nontoxic and safe to use on food. However, they must be removed before serving and are not to be consumed. The Customer should also be aware that although, the icing, petals and leaves of flowers are edible, some other decorations are not (wires, ribbons, pins, jewels, boards etc.). The Customer is responsible for advising their guests of this and the Company will not accept any liability for any loss, damage or injury arising from any such exposure.
16. Venue Set Up & Service - It is the Customers responsibility to check with their venue for restrictions on any part of their order. The Company will not be liable if the venue prevents set up of any restricted elements of their order. It is the Customers responsibility to liaise with their venue for tables, tablecloths and for the cutting and service of their order. The Company are not responsible in any way for the service or cutting of the Customers order.
17. Hire/Loan Items - All hire/loan items are the property of the Company and must not be defaced, tampered with or changed. All hire items are the responsibility of the Customer until they are returned back to the Company. If a third-party damage’s, breaks or loses an item the responsibility still remains with Customer and it is then the Customers responsibility to liaise with the third party. Under no circumstances will the Company liaise with a third party. All breakages, loss or damages will be invoiced to replace like for like and are payable within 7 days from invoice. Unless arranged all hire items must be returned within 3 days. If hire items are not returned a daily hire rate will be payable after day 3 until the hire item(s) are returned to a maximum of 14 days. After 14 day a replacement invoice will be issued. The Company reserve the right to use a suitable alternative if any of our items have been lost or broken and a replacement cannot be sourced before your event. The Company will endeavor to style your cake to fit in with your style, colour scheme and theme of event.
18. Complaints - In the event you have a complaint about your cake, please notify us as soon as possible and within 30 days. If you don’t follow this procedure, there will be less opportunity for the Company to investigate and resolve your complaint. If the cake is consumed you are in acceptance of any mistakes made, including errors on flavour, we will not compensate any costs in these circumstances.
